Продолжаем рассказывать полезное о досудебной строительно-технической экспертизе. Мы уже писали о том, в какой момент нужно заказывать досудебную СТЭ и как использовать ее в ходе судебного разбирательства. Сегодня хотим дать вам пошаговый алгоритм заказа досудебной СТЭ, чтобы вы знали на какие детали важно обращать внимание.

1.
Для начала нужно найти экспертную организацию, с которой вы будете сотрудничать. Грамотному выбору эксперта посвящена вся вторая глава нашего руководства, поэтому здесь не будем останавливаться на этом вопросе.

Далее вам нужно встретиться с экспертом, чтобы получить от него оценку ситуации клиента. Суть этого предварительного обсуждения в том, чтобы понять, на какие результаты вы (и ваш клиент) можете рассчитывать.

Эксперт помогает сформулировать вопрос по экспертизе (см. стр. 19 руководства). Как вы помните, это очень важный момент — на основе вопроса будут в дальнейшем формулироваться исковые требования. В одной из следующих статей мы подробно разберем, как правильно сформулировать вопрос для СТЭ.

При первичном обращении экспертная организация обсудит с вами порядок и сроки, объем и состав предполагаемой строительно-технической экспертизы. После согласования объема и стоимости работ с экспертной организацией заключается договор.

Далее вы должны уведомить другую сторону о намерении привлечь специалистов для проведения экспертизы. Обычно противоположную сторону уведомляют заказным письмом с уведомлением или письмом через курьерскую доставку.

В уведомлении следует зафиксировать:
— название экспертной организации, ее адрес, контактные данные;
— сроки проведения экспертизы, дату осмотра объекта экспертизы;
— предложение явиться представителям второй стороны для совместного осмотра объекта экспертизы и предоставить документы со своей стороны.

Если вы не уведомите вторую сторону о проведении экспертизы, то суд может не принять экспертное заключение в качестве доказательства по делу, как полученное без привлечения к процессу исследования второй стороны.

Для проведения досудебной строительно-технической экспертизы вам нужно будет предоставить эксперту ряд исходных данных и документации для проведения СТЭ их перечень следует уточнить у эксперта.

Далее эксперт выезжает на место, проводит само исследование и по его результатам сделает свое заключение. Заключение эксперта передается в письменном виде. Оно состоит из вводной части, исследовательской и выводов.

Вот этот документ и будет для вас основным аргументом при досудебном разбирательстве и одним из доказательств вашей позиции, если дело дойдет до суда.

7.
Осталось передать результаты проведенной экспертизы противной стороне и сообщить, что в случае невыполнения ваших законных требований вы будете добиваться судебного решения.
