Сделать операции, связанные с передачей денежных средств, безопасными достаточно просто. Для этого необходимо всего лишь использовать такой простой, но имеющий полную юридическую силу документ, как расписка в получении денежных средств.

Нужно ли заверять расписку у нотариуса. В большинстве случаев расписка в получении денег не нуждается в нотариальном заверении, и обладает полной юридической силой. Правда следует отметить, что судебные издержки первоначально оплачивает заявитель, но в случае победы в споре, они будут выплачены ему проигравшей стороной.

Нужны ли свидетели при составлении расписки. При оформлении расписки в получении денежных средств достаточно подписи получателя суммы, однако осторожность никогда не бывает лишней. Подписи всего лишь двух свидетелей исключат все претензии оппонента на подлинность расписки. Несомненно, подлинность расписки можно доказать с помощью экспертизы, но обратиться к двум свидетелям намного проще, чем в дальнейшем оплачивать дорогостоящие судебные издержки.

Как правильно составить долговую расписку. Гражданский кодекс не требует, чтоб расписка в получении денег имела какую-то определенную форму. В расписке необходимо указать данные о размере суммы, сведения о совершенной операции, паспортные данные и информацию о фактическом проживании участников сделки. Как правило, в расписке обязательно присутствует фраза о том, что стороны, совершившие сделку, не имеют претензий друг к другу. Для расписки обязательно точное указание даты проведения сделки и наличие подписей обеих сторон.

Расписка в получении денежных средств – это документ, оформление которого не отнимает много времени, а значит ее использование в большинстве сделок, связанных с передачей денежных средств совсем не будет лишним.

Расписку в получении денежных средств нужно оформлять в случае передачи денег от арендатора жилья арендодателю. Эта небольшая формальность убережет отношения арендодателя и арендатора от лишних подозрений и недомолвок, что очень удобно и надежно.

Расписка в получении денег помогает уберечь себя от действий недобросовестных людей. Но иногда и расписку можно трактовать неоднозначно. Так, например, в случае оформления двух расписок могут возникнуть лишние проблемы и вопросы, связанные с суммой сделки. Будет лучше и надежнее, если расписка будет одна. В случае расхождения реальной и рыночной стоимости недвижимости можно внести в расписку поправку, в которой следует указать, что данная сумма взимается за улучшенное состояние квартиры, или некоторые предметы интерьера, остающиеся в ней.
